I have a fully functional magic guild lvl 3 and have played many battles as an elf both normal and charmer with lvl 3 spells.
However in this combat

I had the required mana and magic guild and casting of phantom does not require magic guild lvl 3 yet I could not cast it |

| Umm I think i need basic nature magic for the spell even though it says without basic nature magic I can cast phantom on tier 4 troops and teirs 5 6 7 require basic mster and expert. none the less I guess QATC |
Just re-opened to add some more information, but I will close again.
It is as Wolfdeath described, some factions will innately have level 3 spells without the required talent.
The other exception is the "wisdom" talent as seen in the Wizard talent wheel. This allows the hero to use any magic guild 3 spells without the required talent. This means they will be at the minimum level (one below basic).
For example - a wizard with the wisdom talent can use summon phantom, but only upto tier 4 as you pointed out earlier. :)

| Level 3 spells need always at least the basic magic talent or the wisdom talent from the sorcery branch, regardless of the faction. The only exception to this are certain rare sets like demonic soldier (fireball) or paladin set (mass chastise). |
